Seeking consent for genetic and genomic research can be challenging, particularly in populations with low literacy levels, and in emergency situations. All of these factors were relevant to the MalariaGEN study of genetic factors influencing immune responses to malaria in northern rural Ghana. This study sought to identify issues arising in practice during the enrolment of paediatric cases with severe malaria and matched healthy controls into the MalariaGEN study.

This paper argues that professionals who make boundary-related decisions should be guided by relationship-based practice. In our roles as service users and professionals, drawing from our lived experiences of professional relationships, we argue we need to move away from distance-based practice. This includes understanding the boundary stories and narratives that exist for all of us – including the people we support, other professionals, as well as the organisations and systems within which we work. When we are dealing with professional boundary (...) issues, we should centre relationship-building skills that are central to many other aspects of our work. Skills that foster relationships at all levels – between professionals, service users, and services – need to be revalued. Our final recommendation is to create, develop, and foster safer spaces within and outside of organisations, as well as inter-professionally, for the discussion and exploration of boundary-related issues and practice. We are interested in hearing from those with experiences of being marginalised by boundaries so that they can inform a reshaping of our collective ideas around boundary related practices. To foster relationship-based practices in organisations, we have outlined several recommendations here; however, we recognize that these do not go far enough, and that collective action is needed to inform systemic change. Considerations of justice and concern for well-being support conducting mental health research and addressing ethical concerns specific to mental health research are critical. We discuss these concerns, provide recommendations to enable the ethical conduct of mental health research, and argue that participants’ interests should be given primary weight in resolving apparent dilemmas. We also comment on provisions of two legislative actions in India relevant to mental health research: Rights of Persons with Disability Act 2016 and the Mental Health Care Act (...) 2017. Both conform to the 2006 United Nations Convention on Rights of Persons with Disabilities of which India is a signatory. Both provide protections and enumerate rights relevant to people with mental health conditions but with differing focus. The commonalities and differences between the three are discussed in the background of international literature on research in mental health conditions. Studies involving deception and future directions for ethical requirements regarding genetic research are discussed. (shrink)

BackgroundIn the Canadian Alliance for Healthy Hearts and Minds (CAHHM) cohort, participants underwent magnetic resonance imaging (MRI) of the brain, heart, and abdomen, that generated incidental findings (IFs). The approach to managing these unexpected results remain a complex issue. Our objectives were to describe the CAHHM policy for the management of IFs, to understand the impact of disclosing IFs to healthy research participants, and to reflect on the ethical obligations of researchers in future MRI studies.MethodsBetween 2013 and 2019, 8252 participants (...) (mean age 58 ± 9 years, 54% women) were recruited with a follow-up questionnaire administered to 909 participants (40% response rate) at 1-year. The CAHHM policy followed a restricted approach, whereby routine feedback on IFs was not provided. Only IFs of severe structural abnormalities were reported.ResultsSevere structural abnormalities occurred in 8.3% (95% confidence interval 7.7–8.9%) of participants, with the highest proportions found in the brain (4.2%) and abdomen (3.1%). The majority of participants (97%) informed of an IF reported no change in quality of life, with 3% of participants reporting that the knowledge of an IF negatively impacted their quality of life. Furthermore, 50% reported increased stress in learning about an IF, and in 95%, the discovery of an IF did not adversely impact his/her life insurance policy. Most participants (90%) would enrol in the study again and perceived the MRI scan to be beneficial, regardless of whether they were informed of IFs. While the implications of a restricted approach to IF management was perceived to be mostly positive, a degree of diagnostic misconception was present amongst participants, indicating the importance of a more thorough consent process to support participant autonomy.ConclusionThe management of IFs from research MRI scans remain a challenging issue, as participants may experience stress and a reduced quality of life when IFs are disclosed. The restricted approach to IF management in CAHHM demonstrated a fair fulfillment of the overarching ethical principles of respect for autonomy, concern for wellbeing, and justice. At the International Legal Ethics Conference IV held at Stanford Law School between 15 and 17 July 2010, one of the two opening plenary sessions consisted of a panel who debated the proposition that legal ethics should be mandatory in legal education. The panel included leading legal ethics academics from jurisdictions around the world—both those where legal ethics is a compulsory part of the law degree and those where it is not. It comprised Professors Andrew Boon, Brent Cotter, Christine (...) class='Hi'>Parker, Stephen L Pepper and Richard Wu, and was organised and chaired by Professor Kim Economides. This is an edited version of the panel's discussion. It provides a useful summary of the state of legal ethics teaching in the jurisdictions represented as well as a marshalling of the arguments for and against legal ethics as a required course in the university law degree. Of the philosophers in recent times who have striven to heal this rupture between head and heart perhaps none has caught the fancy or stirred the hopes of the American philosophical community as Alfred North Whitehead has. But since the master started this task too late in life, it was left to his disciples to complete his work. And of those disciples who have continued the master's healing in theology, perhaps none has been so energetic or resourceful as Professor Charles (...) Hartshorne. While Professor Hartshorne has usually practised this therapy alone and unaided, he has on one notable occasion enlisted the aid both of another contemporary theological therapist, Professor William L. Reese, and also of most of the great philosophers in history. The fruit of this collaboration, Philosophers Speak of God, while not adding anything essentially novel to Professor Hartshorne's earlier work, presents the physician not only as an isolated laboratory researcher but also, with Professor Reese's help, in the process of actually confronting and healing his patients. Hence this book is an especially interesting and valuable case study of one type of contemporary attempt to cure theological schizophrenia. Theological therapists are to be found among scientists as well as among philosophers, moreover, for even in science the intellect does not- succeed in quieting the restless heart until it finds the God for which that restless heart seeks. Going "through the world with a reverent attitude yet an almost total absence of doctrine or belief--with a religious heart and a skeptical head... is," as we are told in a recent book representing this theological therapy from the point of view of a scientist--a biologist and natural historian--Alexander F. Skutch's The Quest of the Divine, "a most unsatisfactory way to live.". (shrink)

Skene and Parker are demonstrably mistaken in suggesting that the amicus role of Catholic bishops in three cases has been concerned with “developing” the law. In contrast with Skene and Parker’s freestanding conception of legal principle, the Catholic understanding of law’s rational moral foundations has permitted Catholic bishops to defend longstanding legal principle as well as defending the integrity of the church’s health care and welfare services. It is shown that in the three cases under discussion Catholic bishops (...) were providing needed argument otherwise unavailable to the courts in defence of existing statute. In face of the attempts by pressure groups to bypass the legislature and use the courts to subvert fundamental legal principles, the church is perhaps uniquely capable of continuing to provide to the courts rational defences of those principles. Classical pragmatism, despite its recognized concern for questions of freedom and democracy, has little to say directly about questions of power. Some commentators have found Dewey’s notion of habit to be a resource for taking up issues of power while others have argued that pragmatism does not provide a sufficiently critical tool to challenge systematic oppression. Still others have proposed to shore up pragmatism by using resources found in post-structuralism, particularly in the work of Foucault. This paper begins with this (...) suggestion, but argues that while Foucault offers a useful starting point his conception of power fails—at least in an American context characterized by the experience of pluralism. I then argue that the pragmatist tradition, through the work of Mary P. Follett (1868-1933) has the theoretical resources to generate a conception of power that begins with the experience of pluralism. (shrink)

I defend the view that propositional knowledge can be defined as follows: A knows that p if and only if A believes that p because p. Spelling out the meaning of 'because' in this formula results in a causal-explanatory view of knowledge.

If skepticism is once again fashionable, then much of the credit must go to Peter Unger who gives a sustained defense of an ultra-pyrrhonian position in his book, Ignorance: A case for Skepticism. Starting with a version of the traditional argument that we know nothing about the external world, Unger plunges deeper into skeptical waters by next arguing that there is at most hardly anything which we know to be so; and he scarcely pauses before proceeding to defend the stronger (...) conclusion of ‘universal ignorance,’ the thesis that nobody ever knows anything to be the case. I view Unger's thesis and the arguments that led him to it as a challenge to be overcome, not by an appeal to dogmatism - which Unger sees as the only alternative to skepticism - but by recourse to hard-biting arguments of the sort in which Unger himself puts his faith. In what follows I shall attempt to restate Unger's three main skeptical arguments with a view to showing that their bite is not nearly so hard as he imagines. (shrink)

I argue that a modern gloss on Aristotle’s notions of Form and Matter not only allows us to escape a dualism of the psychological and the physical, but also results in a plausible sort of materialism. This is because Aristotle held that the essential nature of any psychological state, including perception and human thought, is to be some physical property. I also show that Hilary Putnam and Martha Nussbaum are mistaken in saying that Aristotle was not a materialist, but a (...) functionalist. His functionalism should instead be given a materialistic interpretation, since he holds that only the appropriate sort of matter can realize the human psyche. Aristotle’s functionalism is therefore best viewed as a “causal functionalism,” in which functional descriptions enable us to find the right sort of material embodiment. By sidestepping dualistic assumptions, Aristotle also avoids having to deal with any further notion of consciousness. (shrink)

I argue for the following analysis of a freely willed action: an act is done of one's own free will, if and only if, it is an intentional act performed by one acting as a rational agent from unobstructed reasons, and so situated that he or she has the capacity to forbear from performing it.

I answer objections to my article, "The Time-Gap Argument," made by C. Daniels in his "Seeing Through a Time Gap.".

The author of the article discusses a political discourse of the US president Donald Trump. The political discourse is considered to be a type of discourse based on views and beliefs, the purpose of which is to manipulate the consciousness of the addressee using strategies in order to form certain beliefs. The strategy in this case means the plan of implementation of the communicative task, necessary for effective achievement of the addressee’s goal, realized with the help of certain tactics. The (...) choice of the subject matter is determined by the interest to political communication. The author analyses discourse strategies and markers, stylistic and lexico-grammatical means used as manipulative means in Donald Trump’s Acceptance Speech, Victory Speech, and Inaugural Address. Special attention is given to the strategy of improvement, strategy of enhancement, and strategy for evaluation of alternatives. It is known that presidential public addresses are of great importance, therefore communicative skills of politicians and ability to speak in public play a great role in their political career. The analysis of D. Trump’s presidential discourse has revealed the use of discursive manipulative strategies and manipulative markers, numerous repetitions, calls for joint action, the use of ‘unifying vocabulary‘, slogans, inversion. It is noted that the presidential political discourse is an effective means of manipulating the consciousness of the nation and the formation of its outlook. The author concludes that speech manipulation is a complex phenomenon, the effectiveness of which depends on linguistic, psychological, extralinguistic, and social factors. (shrink)

In the article various means that are used for creating the image of Elizabeth II are studied. The choice of the subject matter for the analysis is determined by the interest to the British royal family. The author considers various definitions of the concept ‘image‘ and analyzes its characteristic features. It is noted that image can be positive and negative, controlled and uncontrolled, desired and actual. The image helps to show particular traits of a personality. It is based on the (...) person’s appearance, his or her manners, hobbies, interests, speech peculiarities. It is known that such factors as family environment, sports, pets and hobbies play a great role in the creation of the image. There are the following aspects of the image: professional, social and portrait. Special attention is paid to verbal and non-verbal means of creating an image. The main lexical, phonetic and stylistic characteristic features of the monarch’s Christmas Broadcasts have been singled out. A positive image of the monarch is created with the help of verbal and nonverbal means. The Queen’s public addresses and Christmas broadcasts may serve as an example of verbal means used for image creation. Patriotism, sense of duty, loyalty to traditions, adherence to the rules of Royal etiquette is evident in the communicative behavior of the Queen. It is noted that public addresses play a certain role in the creation of a positive image of the English Queen. (shrink)
